Some much needed clarity from the Supreme Court today in Johnson, Hopcraft and Wrench -v- First Rand and Close Brothers on PCP car finance claims. A significant endorsement from the Court that S140A of the Consumer Credit Act on contractual unfairness does indeed apply to cases where customers are the victims of excessive, undisclosed commissions. We await the FCA's announcement on Monday as to whether a redress scheme for such cases will be proposed.
