The global energy transition is accelerating, bringing new infrastructure investments, emerging technologies, and increasingly complex construction risks. From renewable energy developments and battery storage systems to advanced nuclear facilities and AI-driven data centers, large-scale energy projects involve multiple stakeholders, interconnected contracts, and significant financial commitments. When disputes arise, delays can have consequences that extend far beyond construction schedules. In 2025 alone, the AAA-ICDR administered 108 energy arbitrations under its Commercial and International Rules and 92 energy-related disputes under its Construction Industry Arbitration Rules, highlighting the growing intersection between these industries. So, how can project stakeholders address disagreements before they escalate into costly, project-threatening disputes? In our latest blog, AAA-ICDR VP of Commercial Chimdimma Onyedebelu and Secretariat Managing Director Iman Hyder-Eliz explore how proactive dispute management strategies, including standing neutrals, dispute boards, mediation, and arbitration, can help stakeholders manage risk, preserve project timelines, and support successful infrastructure delivery. As artificial intelligence, digital assets, and increasingly complex technology systems reshape business operations, they are also introducing new challenges for legal counsel. Who is responsible when autonomous AI makes a costly decision? How should contracts address data ownership and digital assets? Are traditional dispute-resolution approaches equipped to handle these emerging risks? For corporate counsel, navigating these questions requires more than understanding the technology. It demands a proactive approach to managing risk, drafting agreements, and anticipating disputes before they escalate. Our latest blog explores the legal and commercial implications of emerging technologies, as well as practical considerations for preparing for the disputes ahead. These issues will also take center stage at the 2026 AAA-ICDR Technology Conference on November 3 in New York City, where legal and technology leaders will examine emerging risks and innovative approaches to dispute resolution. Read the blog to explore what's changing, then register for the conference to join the conversation about what's next. https://lnkd.in/gM38HDXD Abdi Aidid, Sarah Benowich, Gary L.
