TERMS AND CONDITIONS FOR SAMSUNG ODYSSEY 3D MONITOR REVIEW OFFER
Offer begins 12:01 AM Eastern Time (“ET”) July 11, 2025 and ends 11:59 PM ET December 31, 2025 or when supplies are exhausted, whichever is sooner ("Offer Period"). Open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older, have reached the age of majority in their state of residence at the time of participation, are a registered product owner of a Samsung Odyssey 3D Monitor (model LS27FG900XNXZA), and the direct and intended recipients of a product review invitation (the “Offer Invitation”). An Offer Invitation to participate in the submission of a review is not transferable. Void where prohibited by law. Subject to all applicable federal, state and local laws and regulations.
To participate in the offer, click on the link provided in the Offer Invitation e-mail and follow the directions provided to complete and submit a product review of your Samsung Odyssey 3D monitor (model LS27FG900XNXZA) (the “Qualifying Product”) and optionally include an original photo or video taken by you (stock images or video are not permissible) of your Qualifying Product (collectively, the “Product Review Submission”). Optional photo or video must contain an image of your Qualifying Product only. Optional photo must be submitted in .bmp, .png, .gif or .jpg format, be less than 5mb in size, at least 100 pixels tall and 100 pixels wide. Optional video must be submitted via a publicly available link from your YouTube account. If you do not have a YouTube account, you may sign up for a free account at youtube.com. By submitting your information and creating a YouTube account, you will be required to agree to the YouTube Terms of Service available for review at https://www.youtube.com/static?template=terms and Privacy Policy available for review at https://policies.google.com/privacy. If you do not agree to YouTube’s Terms of Service and Privacy Policy, you cannot create a YouTube account and submit a video for the purpose of participating in this offer. Participants must complete all required fields and adhere to the product review guidelines (see below for additional details) for the product review and corresponding offer participation to be eligible. To be considered, when submitting a product review, the participant must use the same e-mail address in which the Offer Invitation was received. Incomplete Product Review Submissions and/or submission of erroneous or incomplete information will result in disqualification. All reviews must adhere to the following guidelines: Reviews must be in English only, focus on your Qualifying Product and reflect your honest opinion of your individual experience using the product and include details about why you like and/or dislike the product. To comply with the FTC Guidelines, a badge (Incentivized Review) will be included with your review to disclose that you are being offered a Reward (defined below) to submit a review. All submitted reviews are subject to Samsung’s Ratings and Reviews Terms of Use and review guidelines, which are included in Exhibit A. In the event of any conflict between these Terms and Conditions and Samsung’s Ratings and Reviews Terms of Use, the Terms and Conditions of this offer shall prevail. Your Product Review Submission may not contain any content (which includes any content incorporated within photo or video of Qualifying Product provided) that Samsung, in its sole discretion, determines to:
(a) be vulgar, offensive, sexually explicit, profane or pornographic;
(b) be derogatory of any race, ancestry, place of origin, color, ethnic origin, citizenship, religion, sex, sexual orientation, age, marital status, family status or disability; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people, products or companies;
(c) be violent or promotes the use of alcohol, illegal drugs, tobacco, or weapons; promotes unsafe activities;
(d) promote any political agenda or message;
(e) contain any personal identification, such as persons’ names, phone numbers, physical addresses or e-mail addresses, URLs or other forms of contact information;
(f) communicate messages inconsistent with the positive image of Samsung’s name;
(g) contain advertisements, “spam” content, or references to other products, offers, or websites;
(h) contain details about prices, promotions, shipping and customer service;
(i) contain critical or spiteful comments of other reviews posted on the page or their authors;
(j) contain any material that violates or infringes another's rights, including but not limited to material that violates privacy, publicity, or intellectual property rights, or that constitutes copyright infringement;
(k) include or refer to any third parties, including but not limited to minors, celebrities, and friends, who have not expressly authorized such inclusion or reference; or
(l) violate any applicable law.
The Product Review Submission must be your own original work. Samsung does not guarantee the posting of any Product Review Submission and reserves the right to reject any offer Product Review Submission and/or review, in its sole and absolute discretion, on the basis that a review does not meet the above criteria or is otherwise offensive or inappropriate. Qualifying reviews will include a badge indicating you received an incentive for participating in the offer.
Limit one (1) Product Review Submission per person, per e-mail address and per household for the duration of the Offer Period. Multiple Product Review Submissions of the same Qualifying Product received from any person, e-mail address or household will be void. All Product Review Submissions become the property of Samsung. Should multiple users of the same e-mail account complete the product review and a dispute thereafter arises regarding the identity of the participant, the authorized account subscriber of said e-mail account at the time of submission will be considered the participant and must comply with these terms. “Authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The first 100 eligible participants to submit an eligible Product Review Submission, as determined by Samsung, will each receive one (1) digital download game code redeemable for a digital copy of The First Berserker: Khazan video game (certain terms & conditions as specified by issuer apply) (Estimated Retail Value (“ERV”) $60.00) (the “Reward”). Game code is valid for use only on a compatible Samsung Odyssey 3D monitor, model LS27FG900XNXZA. Game code must be redeemed via the Samsung Gaming Hub on the compatible monitor or via the Microsoft Store. Reward recipients will be responsible for all taxes (including federal, state and local taxes) and any other costs and expenses associated with acceptance and use of the Reward not described herein as being awarded. All Reward details are at Samsung’s sole discretion. Rewards are provided “as is” with no warranty or guarantee, either express or implied by Samsung. Failure of any potential Reward recipient to comply with these Terms and Conditions may result in Reward being forfeited. Rewards are not transferable, redeemable for cash or substitutable except by Samsung, which reserves the right in its discretion to substitute any Reward. Limit one (1) Reward per person, per e-mail address and per household for the duration of the Offer Period. Allow approximately four (4) to six (6) weeks from the date of review submission to receive your Reward via e-mail. Rewards will be delivered to the e-mail address where the Offer Invitation was sent. To ensure delivery, please add @promotionsbysamsung.com to your address book. Any Reward returned as non-deliverable will not be re-sent. Samsung reserves the right to not award all Rewards if there are less than 100 eligible Product Review Submissions received.
Offer is governed by the laws of the State of New York without regard to its conflict of laws principles, with venue in New York County, New York. Except where prohibited by law, as a condition of participating in this offer, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this offer, or any Reward awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration in accordance with the Federal Arbitration Act (“FAA”, Title 9 of the United States Code) under the auspices of the American Arbitration Association; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. YOU HAVE A RIGHT TO OPT-OUT OF THIS ARBITRATION PROVISION. IF YOU DO NOT AGREE TO THIS MANDATORY ARBITRATION PROVISION WITH REGARD TO THIS OFFER, THEN WITHIN THIRTY (30) DAYS FROM THE DATE OF YOUR PARTICIPATION, YOU MAY OPT-OUT OF THIS, AND ONLY THIS, PART OF THE TERMS AND CONDITIONS BY NOTIFYING SAMSUNG OF SUCH OPT-OUT REQUEST BY PROVIDING WRITTEN NOTICE AND MAILING SUCH NOTICE TO: SAMSUNG ODYSSEY 3D MONITOR REVIEW OFFER (ATTN: ARBITRATION REJECTION), P.O. BOX 295, GAINESVILLE, VA 20156. Any opt-out received after the thirty (30) day time period will not be valid, and you must pursue your claim, if any, via arbitration pursuant to these Terms and Conditions. Under no circumstances will a participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this offer), and participant further waives all rights to have damages multiplied or increased.
IN THE EVENT THAT YOU OPT-OUT OF THIS MANDATORY ARBITRATION PROVISION, ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS OFFER SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY A FEDERAL OR STATE COURT LOCATED IN NEW YORK COUNTY, NEW YORK.
By participating, participants agree as follows: a) to abide by these Terms and Conditions, and to the decisions of Samsung, which shall be final and binding in all respects; and b) THAT SAMSUNG; BAZAARVOICE, INC.; TRYMARK CONSULTING GROUP, L.L.C.; AND ANY OF THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, RETAILERS, DISTRIBUTORS AND SUPPLIERS, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND EMPLOYEES (COLLECTIVELY, THE “RELEASED PARTIES”) SHALL HAVE NO LIABILITY AND SHALL BE HELD HARMLESS FOR ANY DAMAGE, LOSS OR INJURY TO ANY PARTICIPANT OR ANY THIRD PARTY RESULTING FROM PARTICIPATION IN THIS OFFER OR THE USE OR MISUSE OF ANY REWARD. Released Parties are not responsible for errors, problems or difficulties of any kind whether computer, network, human, mechanical, electronic, printing, typographical or otherwise relating to or in connection with this offer, including, without limitation, errors, problems or difficulties which may occur in connection with the administration of the offer or damage to entrant’s or other person’s hardware or software as a result of participation or use of the Reward. Released Parties are also not responsible for Product Review Submissions or Rewards that are lost, late, incomplete, inaccurate, delayed, misdirected, undelivered, garbled or delayed by computer transmissions and all such Product Review Submissions or Rewards are void. Persons found tampering with or abusing any aspect of this offer as solely deter¬mined by Samsung will be disqualified. Samsung reserves the right in its sole discretion to modify, suspend or terminate the offer for any reason, including, but not limited to Acts of God, epidemic or pandemic, or if compromised by non-authorized human intervention or other causes which corrupt or impair the administration, security or fairness of the offer. Information submitted in connection with the offer will be treated in accordance with these Terms and Conditions and Samsung’s Privacy Policy (as may be amended from time to time), currently located at http://www.samsung.com/us/common/privacy.html; provided, that in the event of any conflict between these Terms and Conditions and such Privacy Policy, these Terms and Conditions shall prevail. CUSTOMER RATINGS AND REVIEWS TERMS OF USE These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by SAMSUNG (the "CRR Service"). To the extent there is any conflict between SAMSUNG's Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to the CRR Service.
By submitting any content to SAMSUNG, you represent and warrant that:
• you are the sole author and owner of the intellectual property rights thereto;
• all "moral rights" that you may have in such content have been voluntarily waived by you;
• all content that you post is accurate;
• you are at least 13 years old;
• use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.
You further agree and warrant that you shall not submit any content:
• that is known by you to be false, inaccurate or misleading;
• that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any person or entity;
• for which you were compensated or granted any consideration by any third party;
• that includes any information that references other websites, physical addresses, email addresses, contact information or phone numbers;
• that contains any computer viruses, worms or other potentially damaging computer programs or files.
You agree to indemnify and hold SAMSUNG (and its parent, affiliates, subsidiaries, agents, joint ventures, and third-party service providers, including but not limited to Bazaarvoice, Inc., and their respective officers, directors, and employees), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of any third party.
For any content that you submit, you grant SAMSUNG a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, fully transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
All content that you submit may be used at SAMSUNG's sole discretion. In accordance with applicable law, SAMSUNG reserves the right to change, condense or delete any content on SAMSUNG's website that SAMSUNG deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. SAMSUNG does not guarantee that you will have any recourse through SAMSUNG to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, SAMSUNG reserves the right to remove or to refuse to post any submission for any reason in accordance with applicable law. You acknowledge that you, not SAMSUNG, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of SAMSUNG, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.
By submitting your email address in connection with your rating and review, you agree that SAMSUNG and its third-party service providers may use your email address to contact you about the status of your review and other administrative purposes.
