At a recent meeting of Miles' Employment Practice Area Group, attorneys and mediators talked about the latest trends in employment law. “We have larger clients than we did ten years ago,” says Helen Holden, employment law advisor and litigator at Spencer Fane LLP in Phoenix, Arizona. “We’re also seeing more pro se plaintiffs, thanks to AI, and more national plaintiffs’ firms that are AI-driven and are taking cases as a lower dollar value than before. That leads to more cases.” Mediator Steve Dunn is also seeing an uptick in plaintiffs representing themselves. “I have heard from many lawyers that they have increased volume of pro se cases, a lot of which is driven by AI,” says Dunn, who’s based in Charlotte, North Carolina. Employment case values are also on the rise, adds Holden. “With dollar values and case values going up, it’s pushing more clients to say, ‘nope, we’re going to litigate,’ and not settle as early as they might previously have had before,” says Holden. Yet Dunn believes that early mediation is a smart option to resolve pro se cases and has seen defense clients willing to pay for the plaintiff’s mediation costs if the case settles. That makes mediation more appealing for pro se clients and helps keep defense costs down as well. Counsel for both plaintiffs and defense are relying on AI to prepare for employment mediations. “We’ve got it — we’re using it,” says Holden. “AI is generating summaries and looking at more documents than in the past so you’re going to get more robust briefings on both sides.” The summaries are no substitute for a pre-mediation call, however. “A pre-mediation call is critical,” says Holden, who mediates cases in addition to representing clients as an attorney. “I like them. As an advocate, it gives an opportunity to give the mediator information, and as a mediator, getting information from counsel gives color to the case.” Have an employment case you’d like to resolve?
