About Olive Preload

Olive makes it easy for you to enjoy your CDs. We understand that when you move to a new audio system, you want to take along your music. That's why we offer our Preload service as part of every OPUS purchase. When you order Preload it goes like this:

In providing the Preload, Olive strives at all times to comply with U.S. and international copyright law, as well as any other applicable worldwide property rights laws. For this reason, Olive cannot and will not accept for processing any CDs that are not owned by you, that are not original (such as copied or counterfeited CDs), or CDs that contain copy-protection technology. The music imported to your OPUS is intended solely for your personal use. Olive is not responsible for any unauthorized reproduction, distribution or other use of the digital music library by you or any other party. If you have questions or concerns about your use of these digital music library services, we encourage you to consult legal counsel in your jurisdiction.

Your content

You are responsible for the accuracy and completeness of all information that you provide to Olive on the website or by phone in connection with ordering the Olive Preload service. You are also responsible for the legitimacy of any and all CDs that you send to Olive for uploading to your Olive OPUS. You represent and warrant that any and all such CDs are owned by you, are original, and are not copy-protected. You also represent and warrant that Olive's use of the CDs to provide these services will not violate the intellectual property rights or other proprietary rights of any third party.

Your eligibility

You must be at least 18 years of age to use the Olive Preload service. If you are under 18 years of age, you must have parental consent to use the service, and your parent or legal guardian must order any and all products offered through www.olive.us in his or her own name. You agree to provide Olive with complete, true and accurate biographical and contact information for purposes of obtaining any feature of the service and you will promptly inform Olive of any updates to such information as necessary to keep it complete, true, and accurate. You also agree to use any and all digital music for personal use only, and not to reproduce, distribute or otherwise use the products without the express permission of the copyright owner(s) whose content is on or contained within the products. You understand that the music preloaded onto the OPUS is intended by Olive for use and storage on the device only, and that you will not engage in activities to duplicate music beyond the device.

Encoding formats

Our philosophy is clear. Crystal-clear. That is why we only offer a special lossless audio format (FLAC) to encode your music. The benefit of FLAC is that it uses only about half the space of uncompressed audio, but still offers the original CD audio quality during playback.

Cost of service

The following charges apply for Olive's Preload service:

Only CDs that are actually imported are counted. Special discounts may apply. Olive will charge a flat fee of $50 for CDs that are sent in jewel cases, booklets or other means.

Limited time offer

For a limited time Olive includes the free Preload of CDs with the purchase of one of its pure audio systems. The following limits apply for each system.

Canceling Preload service

The following charges apply if you decide to cancel your order of the Preload service:

Charging the credit card

When you place an order for an Olive OPUS with Preload your credit card is charged for the total amount of your order once your CD collection has arrived at Olive and is being preloaded.

Expected service time

Once we have received your CDs, the turnaround time of most orders is between 5 and 15 days.

Scratched and damaged CDs

If a CD cannot be read due to a scratch or dirt we will clean it and retry. If it still does not read the music will not be uploaded to your OPUS. Olive is not liable for any scratched CDs and you indemnify Olive against, and hold Olive harmless from, all claims, liabilities, losses, expenses, and damages arising or resulting from such damage. We recommend our customers ensure their CDs when sending them to Olive. CDs are insured with the freight carrier during transport from Olive to Customer.

Lost CDs

Olive is not liable for CDs that are lost during transport. If the number of CDs deviates from the number you shipped, it is your responsibility to file and manage the claim with the freight carrier. You indemnity Olive against, and hold Olive harmless from, all claims, liabilities, losses, expenses, and damages arising or resulting from such damage.

Olive is not liable for any CDs that customer claims have been lost during the processing of the Preload service.

CDs with copyright protection

Copy protection is a limitation installed on the disc from the manufacturer and encoding these discs would be a violation of this copyright protection. Olive will not upload these CDs onto your OPUS.

Reload during warranty period

If you purchased the Preload service in conjunction with an OPUS, and you lose the preloaded music due to a defect that is covered under the standard Olive warranty for the OPUS and during the warranty period, we will also reload your CDs for you. In this case you will need to send in your CDs again, and you will be charged for the return freight for the CDs.
